Minutes

The Texas State Library and Archives Commission (TSLAC) met on Tuesday, February 6, 2001, at 10:00 a.m. at the State and Local Records Management facility at 4400 Shoal Creek in Austin.

1. Tour of state records center and talking book circulation department

Michael Heskett and Jenifer Flaxbart conducted a tour of the State Records Center for Commissioners Brisack, Carr, and Sanders. A quorum was not present and no action items were discussed. The tour concluded at 12:00 p.m., and the Commissioners recessed for lunch.

Chairman Palmer re-convened the meeting at 1:15 p.m, with a quorum present.

2. Approve Minutes of the November 10, 2000, Commission meeting.

Commissioner Carr and Commissioner Brisack each noted one revision to the full-commission minutes. Commissioner Carr moved to approve the minutes as corrected; Commissioner Brisack seconded. Motion passed.

3. Report of the Director and Librarian.

Michael Heskett, director, State and Local Records Management, as well as Erica McKewen, communications officer, reported on the following items in lieu of Director and Librarian Peggy D. Rudd:

  • Senate Finance Committee recapitulation – Michael Heskett
  • Friends of Libraries and Archives of Texas new logo – Erica McKewen

The Commission liked the new logo for Friends of Libraries and Archives of Texas.

Commissioners were very pleased with Peggy D Rudd’s visit to the Rio Grande Valley.

4. Approve contracts greater than $100,000.

The Commission extended the current contract with Amigos for the TExpress courier service through six months.

Commissioner Brisack moved to approve the contract with Amigos for the TExpress courier service; Commissioner Carr seconded. Motion passed.

5. Approve acceptance of gifts greater than $500.

Commissioner Palmer read the following gifts to be reviewed:

The Talking Book Program received a $2,500 donation deposited on November 14, 2000 from Katherine Basile of Fort Davis, Texas.

The Genealogy section of Archives Reference and Information Services division received a $500 donation deposited November 6, 2000 from the ARCO Foundation. The donation was a match to a $500 donation given to Genealogy by ARCO employee Ronald Baker.

Commissioner Sanders moved to accept the gifts; Commissioner Brisack seconded. Motion passed.

6. Discuss and approve Audit Committee recommendations on the Audit Report on Library Resource Sharing Division

Commissioner Carr moved to accept the audit recommendations; Commissioner Sanders seconded. Motion passed.

7. Approve adoption of rules: Rule review of chapter six

Michael Heskett reviewed the rules concerning the state agency microfilming and electronic records retention periods and answered questions from the Commission.

Commissioner Carr moved to readopt Title 13, Chapter 6 rules; Commissioner Sanders seconded. Motion passed.

8. Approve adoption of rules: fleet management rules, chapter 2, �2.70

Michael Heskett explained that no comments were received pertaining to the rules 13 TAC.

Commissioner Brisack moved to adopt rules; Commissioner Carr seconded. Motion passed.

9. Authorize publication of proposed rule repeal relating to microfilming fees, chapter 6, �6.121

Michael Heskett requested permission to publish service fee schedules repeal.

Commissioner Sanders moved to grant permission; Commissioner Brisack seconded. Motion passed.

 

10. Authorize publication of proposed rule repeal relating to microfilming fees, chapter 6, �6.121

Michael Heskett requested permission to repeal the rules.

Commissioner Brisack moved to grant permission; Commissioner Carr seconded. Motion passed.

11. Approve adoption of rules: amendments to TexShare administrative Rules, chapter 8, ��8.1-8.6

Michael Piper spoke to the Commission about amendments to the TexShare Rules to reflect public library eligibility.

Commissioner Palmer commended Piper on his tenure at the Texas State Library and Archives Commission and recommended approval of revisions to TexShare rules to include public libraries.

Commissioner Brisack moved to adopt revised rules; Commissioner Sanders seconded. Motion passed.

12. Authorize publication of proposed new rule relating to staff training, chapter 2, �2.56.

Donna Osborne spoke to the Commission about authorizing a staff training publication.

Commissioner Carr had two editing suggestions to the publication.

Commissioner Brisack made two editing suggestions to the publication.

Commissioner Carr moved to approve the publication of the new staff training rules; Commissioner Brisack seconded. Motion passed.

13. Approval of revised Employee Guide

Donna Osborne reviewed the revised Employee Guide with the Commission and answered various questions.

The Texas Commission on Human Rights, the Attorney General’s Office, and the 76th Texas Legislature each suggested revisions to the Employee Guide.

The Commissioners made multiple editing suggestions and one substantial suggestion on page eighty-five of the revised Employee Guide.

Commissioner Carr noted that salary decreases should not be used as a disciplinary action; therefore, the statement should be deleted from the guide. Commissioner Palmer concurred.

Commissioner Carr moved to table the approval of the guide pending further investigation by staff regading the legality of some of the statements; Commissioner Brisack seconded. Motion passed.

Commissioner Brisack commended the staff on the guide.

Commissioner Carr moved to take the issue off table; Commissioner Brisack approved. Motion Passed.

Commissioner Carr moved to approve stylistic and grammatical edits, statutory changes, and the Attorney General recommendations only; Commissioner Brisack seconded. Motion passed.

Commissioner Carr moved to table further discussion of the guide; Commissioner Sanders seconded. Motion Passed.

14. Resolution honoring clarence hall on his retirement

Chairman Palmer read the resolution honoring Clarence Hall for his service to the agency.

15. Public comment

There was no public comment.

 

The Commission set meeting dates for May 29 and September 24, 2001.

Chairman Palmer commended Jenifer Flaxbart on her tenure at the Texas State Library and Archives Commission. Flaxbart introduced Troy Hoyles, who will serve as the acting director of the Talking Book Program in Flaxbart’s absence.

Chairman Palmer adjourned the meeting at 2:35 p.m.
