Agency holdings: Retained by the agency for three years. Actual holdings of the agency are 1993-[ongoing]. The agency transferred records from 1985-1992 to the Archives recently.

Although this transfer was accepted by the Archives, the acceptance was based on a previous description of the contents of the series provided by the agency, which no longer holds true. This description can be found in the appraisal report prepared by the Archives and Information Services Division for the Structural Pest Control Board in January, 1996. The Archives will not be maintaining these records because this series does not constitute administrative correspondence.

Description: This series consists of routine incoming and outgoing correspondence between agency staff and other state agencies. Dates covered are 1985-[ongoing]. This is routine correspondence with state agencies concerning general administrative activities, including audits, budget preparation, accounting and payroll, etc. Correspondence relating to complaints and enforcement activities of the board are filed in another series, Complaint files.

Purpose: This series documents the agency's handling of its routine administrative functions.

Agency Program: The Structural Pest Control Board works to protect the health and welfare of citizens and the environment against the misuse of pesticides and promotes standards for the industry. Major responsibilities of the Board are promulgating rules and regulations for licensing, examination, and training; administering licensing exams or granting waivers when appropriate; issuing licenses; inspecting pest control work of licensees; investigating allegations of improper application of pesticides or other violations of the Structural Pest Control Act; administering mandatory continuing education for certified applicators; and operating a public information program about the practice and regulation of structural pest control in the state.

Appraisal Decision: The initial appraisal decision made on this series was that these records were archival, a decision which was based on data given to us by staff at the agency. The agency recently transferred the older correspondence, dating 1985-1992, to the Archives and Information Services Division. When these records were reviewed by appraisal staff, it was discovered they did not contain the administrative correspondence which had been described but rather consisted of routine state agency correspondence, concerning administrative functions such as payroll, accounting, budget preparation, and audits. Further contact with the agency about the contents of the administrative correspondence they hold now confirms the contents of this series to be non-archival. Therefore, the appraisal decision initially issued for this series in the appraisal report of January 1996 has changed. This series has been appraised to be non archival. Remove the archival code of "R" from the retention schedule. Additionally, change the series item number to 1.1.008, to reflect the general nature of this correspondence series. Further, add a note in the Remarks column - "Archival review code removed subsequent to appraisal by the Archives and Information Services Division of the Library and Archives Commission, March 19, 1997".

Agency holdings: None. When the agency was ready to transfer older files to the Archives, it was discovered this is actually an empty series. Correspondence relating to enforcement is filed in the Complaints files series. It may have been maintained separately at one time, but is not any longer. Additionally, the description of what was supposed to be in the files was not entirely correct. The enforcement correspondence is only correspondence relating to complaints. See the appraisal report of January 1996 for a fuller description of the contents of the series provided to the Archives.

Agency Program: The Structural Pest Control Board works to protect the health and welfare of citizens and the environment against the misuse of pesticides and promotes standards for the industry. Enforcement responsibilities of the Board include promulgating rules and regulations concerning investigation and enforcement activities; inspecting pest control work of licensees; and investigating allegations of improper application of pesticides or other violations of the Structural Pest Control Act. The board also acts as the investigative arm of the EPA in Texas by investigating and referring to the EPA violations of the Federal Insecticide, Fungicide, and Rodenticide Act.

According to recent data from the agency, the agency files any correspondence relating to enforcement in the Complaint files, a series we have already appraised to be non archival. Since this series, Correspondence, enforcement, has been determined to be empty and obsolete, the appraisal decision initially issued for this series in the appraisal report of January 1996 has changed. Remove the series completely from the retention schedule.

This includes investigation and referral to the EPA violations of the Federal Insecticide, Fungicide, and Rodenticide Act. Additionally, the Board has the responsibility for developing standards and criteria for the use of pesticides and other related chemical agents at school buildings and other facilities of school districts.

This series may have existed at one time, but not any longer. Since this series has been determined to be empty and obsolete, the appraisal decision initially issued for this series in the appraisal report of January 1996 has changed. We had initially instructed the agency to add the series to the schedule. Since there are no records present, nothing further needs to be done with this series.
