Sir
[Y]ou received
from the authorities of Yucatan in July 1842 as reported by
yourself, the sum of Forty one thousand nine hundred and
Seventy one dollars ($41,971.00) and this Dept. is informed
that you did not appropriate the same to the payment of
the officers, seamen, and marines, in Service[.] You recd on the 23rd
July 1842 the Sum of Eighteen thousand eight hundred
and Twelve 74/100 dollars ($18,812.74) issued upon your requisition
as sufficient for the outfit of the Ship Austin and Brig
Wharton, for active Service—of the disbursements of the above
sums of money you have exhibited to the authorities of
this Government no account as required by law.
On the 29th October 1842 you were ordered to
report with the vessels under Your command at Galveston[.] [O]n
the 5th Nov 1842 this order was repeated to You. On the 16th Nov
1842 this order was again repeated. On the 2nd Dec 1842 You
were ordered to repair to this place, and report in person to the
Dept of War & Marine[.] [O]n the 2nd January 1843 this order was
renewed.
All of the above enumerated orders, you disobeyed. On
the 22nd January 1843 You were peremptorily ordered to turn
over the Command to the Senior Officer in the Naval Service
present, and report to the Dept of War & Marine at this
place in person. In reply to this order, You commu-
nicated to this Dept under date 10th March 1843 that “it is
of course unnecessary for me to proceed to the Seat of Government”
and “I expect to get to sea in a few days and keep at sea
until the termination of our difficulties with Mexico,
without any expense to the Government of Texas.”
